this multimoulures.com website (the “Site”), is owned and operated by MULTI-MOULURES INC. (“Multi-Moulures”), having its head office at 410, rue Hocquart, Saint-Bruno-de-Montarville (Quebec) J3V 6E1. By accessing and using this Site, you unconditionally agree to be bound by these Terms of use of use (the “Terms of use”) and all applicable laws. If you do not accept and agree with these Terms of use, do not visit the Site.

Multi-Moulures reserves the right, at its sole discretion to change, add or remove portions of these Terms of use, at any time. It is your responsibility to periodically check these Terms of use, available on the Site, for changes.  Your continued use of the Site following the posting of changes will mean that you accept and agree to such changes.

Multi-Moulures may, at its sole discretion, modify at any time the Site or any part thereof, to suspend the Site, to modify or withdraw services or products offered thereon, without notice or delay. Multi-Moulures will not be responsible in any way, to any party for any loss or damages that may result, directly or indirectly from any (i) modification or suspension of the Site; or (ii) modification or withdrawal of services or products offered thereon.

All the content of this Site is subject to Multi-Moulures’ intellectual property rights under applicable laws of Canada or other countries and international treaties. The Site is accessible based on its availability and Multi-Moulures makes no warranties, either express or implied, that the Site will operate without interruption, virus or error or in a secure and timely manner, that the information contained is accurate and without error, or that defects in the software and applications, if any, will be rectified. Communication over the Internet is subject to interception, loss or alteration and you acknowledge that Multi-Moulures shall not be held liable for damage resulting from the transmission of confidential information or personal information over the Internet and that such communications are at your own risk.

LIMITATION OF LIABILITY

Usage of the Site is at your sole risk and Multi-Moulures makes no warranty, express or implied, that (i) the Site will meet your requirements or result in revenues or profits; (ii) access to Site will be uninterrupted, timely, secure, or error-free; and (iii) the results that may be obtained from the use of the Site will be accurate or reliable. 

In no event will Multi-Moulures be liable for any indirect, incidental, consequential, special, punitive or exemplary damages or lost profits, even if Multi-Moulures has been advised of the possibility of such damages. In no event Multi-Moulures’ cumulative liability to you or any other party for any loss or damages resulting from any claims, demands, or actions arising out of or relating to this agreement shall not exceed the fee paid to Multi-Moulures by yourself in the last 6 months.

TERMINATION OF USE

Multi-Moulures reserves the right to terminate, at any time and without prior notice, your right to access the Site or your account for any reason, including because Multi-Moulures reasonably believes that (i) your usage of the Site (a) pose a security risk to Multi-Moulures or any third party, including other clients of Multi-Moulures; (b) could adversely impact the Site, Multi-Moulures’ systems or of any other person’s system; (c) could subject Multi-Moulures or any third party to liability; or (d) could be considered fraudulent; (ii) you are in breach of these Terms of use; or (iii) you are in breach of any payment obligations toward Multi-Moulures.

No compensation will be paid for the use of said material and Multi-Moulures will have no obligation to publish or use it.

In these Terms of use (i) the headings have been inserted solely for ease of reference and shall not modify, in any manner whatsoever, the meaning or scope of the provisions hereof; (ii) where appropriate, the singular number set forth herein shall be interpreted as the plural number, and the gender shall be interpreted as masculine, feminine or neuter, as the context dictates; (iii) “or” is used in the inclusive sense of “and/or”; and (iv) the terms “herein”, “hereof”, “hereto”, “herewith”, “hereunder”, “hereby”, and other similar terms,  generally refers to these Terms of use as a whole rather than to a specific part thereof, unless otherwise indicated in the text.

In the event that any provision of these Terms of use is deemed to be invalid or unenforceable, in whole or in part, such provision will, whenever possible to do so, be interpreted, construed, limited or, if necessary, severed to the extent necessary to eliminate such invalidity or unenforceability. All the remaining provisions of these Terms of use will remain valid and continue to bind the parties.

GOVERNING LAW

These Terms of use shall be governed by the laws of the Province of Québec, Canada and you consent to submit all disputes or disagreements arising pursuant to these Terms of use to the exclusive jurisdiction of the courts of the Province of Québec, judicial district of Longueuil.

PROTECTION OF PERSONAL INFORMATION POLICY

MULTI-MOULURES INC. (“Multi-Moulures”, “us” or “we”) is aware of the need to protect the Personal Information provided to us, including while making use of our Site, and is committed to maintain the privacy and security of Personal Information.

This Policy describes Multi-Moulures’ practices with respect to the Collection, Use or Disclosure of Personal Information. The application of this Policy remains subject to applicable legislation, including the Act respecting the protection of personal information in the private sector.

PERSONAL INFORMATION COLLECTED

In the course of its interactions with us, we may Collect, Use or Disclose an individual Personal Information, including:

  • its contact information (name, address, email or phone number);
  • its communications with Multi-Moulures;
  • information about the Site usage and the devices used to that end; and
  • Recruitment-related information as part of a job application (resumes, information about its professional or academic background, etc.).

Multi-Moulures may also process a person’s account credentials, passwords, profile information and other Personal Information it provided to facilitate the use of the Site.

In some cases, Personal Information that includes technical properties and general usage information of software and hardware utilized in conjunction with the Site might be Collected, Used or Disclosed, including the types of web browser, referring or exit web pages, operating system version, hardware used and IP address.

We do not Collect sensitive information, such as political or religious beliefs, ethnic background, sexual preference, health or any other sensitive information. 

We do not seek to Collect information about minors and if you believe your child may have shared its Personal Information with us, please contact us by contacting our Chief Privacy Officer as set forth below.

We shall limit Collection of Personal Information to that which is necessary to fulfil the identified purposes and only Collect such Personal Information by legal means.

HOW WE USE PERSONAL INFORMATION

Except where allowed or required by law, we only Use the Personal Information provided to us for the identified purposes for their Collection and we will not Use them for any other purpose without the consent of the concerned.

By using this Site, you consent to Multi-Moulures use of Cookies and Tracking Pixels which enable Multi-Moulures, among other things, to recognize you when you visit the Site so as to customize your browsing experience based on your preferences and provide a customized offering of services and products on our Site. Multi-Moulures will destroy, de-identify or anonymize any Personal Infomation no longer needed for the identified purposes or required by law according to its established internal controls, schedules and practices.

From time to time, we may ask other members of our group, or Third-party service providers, to help us manage our information technology systems used to process Personal Information. 

We will only Disclose Personal Information to a Third-party service provider where we are satisfied that (i) adequate levels of protection are in place to protect the integrity and security of any Personal Information being processed; and (i) compliance with applicable Personal Information protection legislation is achieved. These measures include use of standard contractual clauses stating the confidentiality of the Personal Information and the identified purposes. 

The Internet is not a secure means of communication and that we make no representations or warranties as to the absolute security of Personal Information so provided. You acknowledge that the transmission of Personal Information via the Internet is at your own risk.

SHARING AND DISCLOSURE

We do not sell or rent any Personal Information to any Third Party except as provided herein.
